Disaster and disaster management in India: the statutory framework built on the Disaster Management Act, 2005, and the trade-offs between relief and mitigation, central standards and local capacity, and development ambition and risk reduction.
What it is
A hazard is a natural or human-induced event with the potential to cause harm; a disaster is what happens when that hazard meets an exposed and vulnerable population whose coping capacity is exceeded. The distinction is written into Indian law. The Disaster Management Act, 2005 defines a disaster as a catastrophe, mishap, calamity or grave occurrence arising from natural or man-made causes, or by accident or negligence, causing substantial loss of life, human suffering, damage to property or degradation of the environment, and of such magnitude as to be beyond the coping capacity of the community of the affected area. The same Act defines disaster management as a continuous and integrated process covering prevention, mitigation, capacity-building, preparedness, prompt response, evacuation, rescue and relief, and rehabilitation and reconstruction. Risk is conventionally expressed as a function of hazard, exposure and vulnerability, divided by capacity — which is why two cyclones of identical intensity produce very different death tolls.
The institutional anchor is a three-tier structure created by the 2005 Act: a National Disaster Management Authority chaired by the Prime Minister, State Disaster Management Authorities chaired by Chief Ministers, and District Disaster Management Authorities headed by the District Magistrate or Collector. A National Executive Committee under the Union Home Secretary handles coordination, the National Institute of Disaster Management handles training and research, and the National Disaster Response Force provides specialised response capacity. Money flows through a State Disaster Response Fund in each state, topped up by a National Disaster Response Fund, with separate mitigation funds provided for. Ministry-wise, the nodal ministry is Home Affairs, with hazard-specific responsibilities distributed — the India Meteorological Department for cyclones, cloudbursts and heat, the Central Water Commission for floods, the Geological Survey of India for landslides, and the Indian National Centre for Ocean Information Services for tsunami warnings.
Internationally, India is a signatory to the Sendai Framework for Disaster Risk Reduction 2015–2030, which sets four priorities for action — understanding risk, strengthening risk governance, investing in risk reduction, and improving preparedness and recovery under a "build back better" principle — and seven global targets covering mortality, numbers affected, economic loss, damage to critical infrastructure, national and local strategies, international cooperation, and access to multi-hazard early warning.
Why it is contested
The first and deepest conflict is between relief and mitigation. Relief is visible, immediate and politically rewarding: cheques, helicopters, ministerial visits. Mitigation — a raised embankment, an enforced building code, a relocated settlement, a restored wetland — pays off invisibly, years later, in a disaster that did not happen, and its beneficiaries do not know who they are. Every incentive in electoral and administrative life pushes money towards response. The statutory creation of mitigation funds alongside response funds, and the Fifteenth Finance Commission's restructuring of disaster funding to carve out a mitigation window, were attempts to force the allocation that politics will not make voluntarily. Whether those windows are actually spent, and on what, remains the live question.
The second is between central standard-setting and the fact that all disaster response is local. The Act's architecture is apex-heavy and Union-led, and the Prime Minister chairs the national authority. Yet the first hour after a cloudburst or a building collapse belongs to a ward officer, a panchayat secretary and a fire station. District authorities are frequently under-staffed, chaired by a Collector with a dozen other charges, and dependent on plans written to satisfy an audit rather than to be used. Municipal bodies and panchayats, the elected local governments created by the constitutional amendments of the early 1990s, sit largely outside the disaster chain despite controlling land use, drainage and building permission — the very levers that determine urban flood risk. The COVID-19 pandemic sharpened the federal question in the other direction, when the Union used the Act's directive powers to impose nationwide measures on subjects states regarded as theirs.
The third is between development ambition and risk reduction, and it is the hardest. Hill highways widened for pilgrimage and defence traffic destabilise slopes; hydropower reservoirs sit below glacial lakes and in high seismic zones; ports, refineries, resorts and housing crowd a coastline exposed to cyclones and sea-level rise; cities absorb wetlands and floodplains because that is where cheap land is. Each of these represents a real socio-economic good — connectivity, energy, employment, shelter — and disaster risk reduction asks that some of it be foregone or made costlier. Coastal Regulation Zone rules illustrate the bind precisely: tightened, they restrict fishing hamlets and small tourism livelihoods as much as large developers; relaxed, they erode the natural buffers, including mangroves, that reduce storm surge damage.
A fourth conflict runs through compensation and entitlement. Response fund norms operate on a list of notified disasters; heat waves and lightning, which together kill large numbers annually, have been the subject of persistent state demands for inclusion, and states have been permitted to use a small share of their response fund for locally significant disasters not on the list. Beneath that lies the question of who counts as a victim: the landowner whose house is damaged is easy to compensate, the tenant, the landless labourer, the street vendor and the migrant worker who lost weeks of income are not. There is also a data problem with an incentive attached — states have reason to maximise assessed damage to draw central funds, while mortality and morbidity from slow-onset hazards such as drought and heat are systematically undercounted.
The competing positions
The Union government and the National Disaster Management Authority argue that only a national body can set minimum standards, invest in early warning science, maintain specialised response forces and hold states to plan-making, and that India's dramatic reduction in cyclone mortality since the late 1990s vindicates that model. India has also positioned itself internationally, through the Prime Minister's ten-point agenda on disaster risk reduction and the Coalition for Disaster Resilient Infrastructure, as an advocate of building resilience into infrastructure at the design stage rather than retrofitting after loss.
State governments accept the framework but contest the fiscal terms. Their case is that hazard profiles differ, that centrally fixed relief norms and a fixed list of notified disasters do not fit local realities, that central assistance arrives after the spending has already been made from stretched state budgets, and that a Union-led structure cannot substitute for state capacity it does not fund.
Finance Commissions and fiscal authorities counter that open-ended relief creates moral hazard: if the Union underwrites losses, states have little reason to enforce building codes or stop encroachment. Their prescription is objective, risk-based allocation, a hard mitigation share and greater use of risk transfer — insurance, catastrophe pools, parametric cover for crops and public assets — so that the exchequer is not the insurer of first and last resort.
Disaster risk reduction professionals and the international community argue that disaster losses are a symptom of development choices, not of nature, and that the correct intervention is upstream: hazard-zoned land use, enforced codes, protected floodplains and wetlands, and resilience designed as robustness, redundancy, resourcefulness and rapidity of recovery rather than as a stockpile of relief material.
Affected communities and rights-based groups press a different claim: relief as entitlement rather than discretion, drawing on the Act's provision for minimum standards of relief; consultation before evacuation and relocation; and rehabilitation that restores livelihoods, not merely housing. Hill and coastal movements go further, opposing specific projects on the ground that the risk is not manageable at any price. Against them, infrastructure ministries, state industry departments and local employment interests argue that halting projects transfers a certain present cost onto poor people to avoid an uncertain future one.
How it developed
For most of the twentieth century India practised relief administration, not disaster management. The lineage ran from colonial famine codes to state relief codes and scarcity manuals, with the subject handled by the agriculture ministry because drought and crop loss dominated it, and with funding through contingency and calamity relief arrangements reviewed by successive Finance Commissions. The approach was reactive and compensatory by design.
Three events forced a rethink within a short span: the Odisha super cyclone of 1999, which killed on the order of ten thousand people; the Gujarat earthquake of 2001, centred on Kutch, which destroyed towns and exposed the absence of seismic code enforcement; and the Indian Ocean tsunami of December 2004, which revealed that India had no ocean warning system at all. A high-powered committee on disaster management at the end of the 1990s had already recommended a dedicated institutional structure, and the nodal responsibility moved to the Ministry of Home Affairs in the early 2000s.
The Disaster Management Act, 2005 followed, in the same year as the Hyogo Framework for Action, giving statutory form to the authorities, forces and funds described above. A national policy came at the end of that decade, and the Second Administrative Reforms Commission examined crisis management in one of its reports. After the Sendai Framework replaced Hyogo in 2015, India adopted its first National Disaster Management Plan the following year, aligned to Sendai's priorities and revised subsequently.
The decade since has been shaped by loss events that were also governance tests: the Uttarakhand disaster of 2013 centred on Kedarnath, the Chennai floods of 2015, the Kerala floods of 2018, cyclones Fani, Amphan and Biparjoy, the Chamoli rock-ice avalanche of 2021, the Sikkim glacial lake outburst flood of 2023 which destroyed a dam on the Teesta, and the Wayanad landslides of 2024. Legislative responses have accumulated: the Dam Safety Act, 2021 created national and state dam safety institutions after decades of ageing structures and the memory of the Machchhu dam failure at Morbi; and an amendment to the disaster management law, passed in this decade, has sought to give statutory status to existing crisis committees, provide for urban disaster management authorities in large cities and state capitals, and provide for state disaster response forces.
Where it stands
The legal and institutional scaffolding is now largely complete; the binding constraints are capacity, enforcement and money at the bottom of the system. Early warning is India's clearest success: the India Meteorological Department's colour-coded system — green for no action, yellow to stay watchful, orange to be prepared and red to take action — together with staged cyclone bulletins, mass evacuation and cyclone shelters, has cut cyclone mortality by orders of magnitude even as economic damage rises. Odisha's near-zero-casualty evacuations are cited internationally. Warning has improved faster than exposure control.
The unresolved questions cluster in four places. First, hazards that early warning cannot easily address: cloudbursts, defined by the meteorological service as extremely intense rainfall over a very small area in a very short time, are generated by deep convection over steep Himalayan terrain and remain hard to forecast at usable lead times; landslides and glacial lake outburst floods behave similarly. Second, urban flooding, which the Commission has treated as a climate-induced disaster in its own right, and which is produced less by rainfall than by encroached wetlands and drains, unregulated construction on floodplains, concretised catchments and poorly timed reservoir releases — the shared story of Mumbai in 2005, Chennai in 2015, Hyderabad, Bengaluru and Delhi since. This is where the topic joins urbanization: problems and remedies, because the remedy is municipal land-use governance. Third, the climate change link: warming seas, more intense rainfall events, sea-level rise on a long coastline of roughly seven and a half thousand kilometres, and heat as an emerging mass-casualty hazard, all of which shift the baseline that hazard maps and building codes assume, and connect Indian practice to international adaptation and loss-and-damage finance. Fourth, the fiscal architecture: whether mitigation windows are spent, whether insurance and risk transfer scale, and whether relief norms become entitlements with standards or remain discretionary.
Taking a view
The distinction that carries most answers is between hazard and disaster, and between exposure and vulnerability. If a question asks about causes of urban flooding, dam failure or landslide loss, the analytical move is to show that the natural trigger explains the event but not the damage, and that the damage is the product of decisions about where to build, what to enforce and whom to protect. From there, structure by the phases — mitigation, preparedness, response, recovery — and say honestly which phase India does well and which it neglects. On resilience questions, define it as the capacity to resist, absorb, adapt and recover in a timely way, and treat it as measurable through robustness, redundancy, resourcefulness and speed of recovery, tying that to the Sendai priorities and targets rather than reciting them as a list.
The usual trap is institutional cataloguing: an answer that walks from the national authority down to the district authority, names the response force and the funds, and never argues anything. The second trap is attributing failure to "lack of awareness", which is rarely the operative cause. The evacuation record shows Indians act on warnings; what fails is the regulation of exposure between disasters.
A defensible view can be stated in a sentence and defended in a paragraph: India has built a strong warning-and-response state and a weak risk-reduction state, so the marginal rupee and the marginal reform belong at the district and municipal level — staffed district authorities, enforced land-use and building rules, protected wetlands and floodplains, and mitigation spending with a statutory floor — while relief moves from discretion towards a standard entitlement that reaches tenants and informal workers, not only property owners. Concede what this costs: it forecloses some hill and coastal development, raises construction costs, and asks poor households to move from land they occupy.
